These Terms and Conditions (“Terms”) govern your use of the website luviaelements.eu and the purchase of products offered by Bc. Katarina Gavulova, Dénešova 6, 04023 Košice, Slovakia. By accessing or using our website, you agree to be bound by these Terms.

2. Scope of Application

These Terms apply to all purchases made through luviaelements.eu and govern the relationship between the seller and the customer. By placing an order, the customer confirms acceptance of these Terms.


3. Products

We specialize in luxury copper baths and related accessories. Product descriptions, dimensions, materials, and images are provided for information purposes. Minor variations in color, texture, or finish may occur due to the handcrafted nature of our products.


4. Prices and VAT

All prices displayed on our website are final and include VAT, unless stated otherwise. Prices may be subject to change without prior notice; however, orders already confirmed will not be affected.


5. Ordering Process

  1. Place desired items into the shopping cart.
  2. Proceed to checkout and enter required contact and delivery information.
  3. Review the order summary and confirm your purchase.
  4. You will receive an order confirmation email.

The seller reserves the right to reject or cancel orders in cases such as suspected fraud, incorrect pricing, or unavailability of goods.


6. Payment Terms

We accept payment methods displayed at checkout. All payments must be made in full before the order is shipped. Your financial data is processed securely, and we do not store payment card details.


7. Shipping and Delivery policy

1. Shipment processing & Production time

Because our luxury copper and brass bathtubs are custom-made and handcrafted to order by our external manufacturing partner, they are not kept in stock.

  • Handling Time (includes Order Processing & Production time): Please allow 23-30 days for your bathtub to be manufactured and prepared for shipment.

2. Shipping & Transit time Once your bathtub is crafted and passes quality control, it will be shipped directly to your address.

  • Delivery time: Shipping usually takes an additional 7 to 15 business days depending on your location.

You will receive a notification with tracking details as soon as your order leaves the production facility.

3. Shipping rates

  • Free Shipping on all orders within EU

4. Shipment confirmation & Order tracking You will receive a Shipment Confirmation email once your order has shipped containing your tracking number(s).

5. Customs, Duties, and Taxes LUVIA Elements is responsible for any customs and taxes applied to your order. All fees imposed during or after shipping are the responsibility of the LUVIA Elements (tariffs, taxes, etc.).

6. Damages If you receive your order damaged, please contact the shipment carrier to file a claim or contact our support at info@luviaelements.eu within 48 hours with photos of the damaged goods.

 

  • We ship within the EU and internationally when applicable.
  • Delivery times vary based on destination and product availability. Estimated delivery times are provided during checkout.
  • Shipping costs will be displayed before confirming your order.
  • The customer is responsible for ensuring the accuracy of the delivery address.

If the package arrives damaged, please document the condition and contact us within 48 hours.


8. Customs and Import Duties

For international orders outside the European Union, the customer may be required to pay import duties or taxes. These charges are not included in the product price and must be covered by the customer.


9. Returns and Refunds

Right of Withdrawal

Customers within the EU have the right to withdraw from the purchase within 14 days of receiving the goods. This applies only to unused, undamaged products in their original packaging.

Exclusions

Custom-made or personalized goods cannot be returned.

Return Procedure

  1. Notify us via email to request a return.
  2. Return the goods within 14 days after approval.
  3. After inspection, a refund will be issued using the original payment method.

Return shipping costs are the customer’s responsibility unless the product is defective.

In the unlikely event that you are not satisfied with your purchase for any reason, you have the right to cancel your order within 14 working days from the day after the date of delivery. To exercise your right of cancellation you must give written notice by post or email, giving details of goods ordered and the delivery details. In the case of returns, we transfer the money paid by the client for the purchase to the same account from which we received payment, within a period of 2 weeks with No Restocking Fee. The cost of transport is not subject to reimbursement.

All non faulty goods must be returned within 14 working days starting from the day after receipt of the goods, and we ask that all goods are returned safely and in their original packaging. Please note that if you do not want to return the goods using your own method a collection charge will be implemented for all non faulty returns, and that this must be paid prior to any collection being processed. Returns outside 14 days will not be accepted. Any returns notified after 14 days will not be accepted. On cancellation for any reason, you must return the goods at your own cost unless we agree otherwise or we confirm that you may dispose of the goods. Where the goods are being returned because they are faulty, incorrect or damaged then we will meet the cost of the return to an appropriate value, but we ask that you allow us to suggest a courier. Reporting Damages

All damages must be reported within 14 days of receipt, outside of this timescall may incur additional charges to you (the customer) to rectify the situation. Electronic images (evidence) will be requested and failure to supply relevant information may extend the timescale of this being resolved.


10. Warranty and Claims

Products are covered under the applicable Slovak and EU consumer protection laws. If you receive a defective item, contact us with photos and a description of the issue. We will assess the claim and offer repair, replacement, or a refund where appropriate.


11. Liability

The seller is not liable for:

  • Damages resulting from improper installation, handling, or maintenance.
  • Delays caused by carriers or customs processes.
  • Indirect or consequential damages.

Our total liability is limited to the purchase price of the goods.


12. Privacy Policy

We process personal data in accordance with GDPR and our Privacy Policy. Information is used solely for order processing, customer support, and legal compliance.


13. Intellectual Property

All content on luviaelements.eu, including images, text, and designs, is protected by copyright and may not be reproduced without written permission.


14. Governing Law

These Terms are governed by the laws of Slovakia. Any disputes shall be resolved by the competent courts of the Slovak Republic.


15. Amendments

Alternative Dispute Resolution (ADR)

We value your trust, and our goal is always to resolve any issues to your satisfaction. However, if you
are not satisfied with the handling of your complaint or if you believe that your rights have been
violated, you have the following options:

1. Request for Redress
Before using formal channels, please contact us at info@luviaelements.eu. If we respond to your
request in the negative or fail to respond within 30 days of the date it was sent, you have the right to
submit a proposal for the commencement of an alternative dispute resolution.

3. ODR Platform (Online Dispute Resolution)

In accordance with EU regulations, you can also resolve your dispute online via the European ODR
platform. This platform is available in all EU languages.
